EB1A: Extraordinary Ability

The EB1A petition is designed for individuals who are at the top of their field—whether in science, education, business, arts, or athletics. To qualify, an applicant must demonstrate sustained national or international acclaim through either:

  • A one-time major achievement (e.g., Nobel Prize, Oscar), or

  • At least 3 of 10 USCIS criteria, such as:

    • Original contributions of major significance,

    • Authorship of scholarly articles,

    • Published material about the applicant,

    • Membership in associations requiring outstanding achievement,

    • Judging the work of others, and more.

NIW (National Interest Waiver)

The NIW petition is ideal for professionals in STEM fields, healthcare, and other advanced sectors whose work benefits the U.S. national interest. Unlike standard EB-2 cases, NIW applicants can self-petition without a job offer or labor certification. To qualify, applicants must:

  • Hold an advanced degree or demonstrate exceptional ability, and

  • Meet the Dhanasar criteria:

    1. The work has substantial merit and national importance;

    2. The applicant is well positioned to advance the work;

    3. On balance, waiving the job offer/labor certification benefits the U.S.


Documents to prepare

For NIW/EB1 cases, the following documents should be submitted to prove the applicants’ research achievements:

  • Cover Letter (written by experienced attorneys to establish the applicant is satisfied the standards based on Matter of Dhanasar)

  • CV

  • Publication – Sample articles published in journals

  • Patent

  • Degree

  • Oral, Poster Presentation Brochures

  • Well-written Letters of Recommendation

  • Citation (Google Scholar)

  • Employment Verification

  • Media (if covered the applicant’s research)

  • Awards

  • Membership

  • Other documents to show the applicant’s achievements  


how many recommendation letters do we need?

Under the law, there is no required number of letters. However, 5-6 letters are good to go. A few letters from experts who can give independent evaluations are also great. A couple of Applicants without letters of recommendation received approvals from the USCIS. Our office provides guidance and drafts for the recommendation letters.
